Summary:

As a litigator, you want your witnesses to be seen as competent, trustworthy, and likable. But most witnesses, under the strain of the testifying process, do
things non-verbally that undercut one or all of those three qualities. A fearful expression here. An averted glance there. And maybe even a disgusted look—
any of these can turn off a swing-vote juror or needlessly antagonize the other side, causing negative emotional fallout that words can’t counteract.
What’s more, with increased use of videotaping in depositions, witnesses need to look just as credible and likable on screen as they would in the
courtroom.

In this lively and informative talk, Drs. Jan and Neal Palmer, principals of Communication Excellence Institute and nationally known experts on
nonverbal communication, quickly zero in on the top 15 must-do nonverbal features that build high credibility in depositions and in the courtroom. They
show attorneys how to:

• Increase the “likability factor” of witnesses through open body language.
• Identify the gestures that will turn off a jury.
• Use body language to show that your witness is “in the moment.”
• Help your witnesses command their space.
• Keep your witness’s voice strong and projecting.
• Cure a witness’s perception of antagonism or arrogance.
• Help witnesses keep their best foot forward and out of their mouth in videotaped depositions and in trial testimony.

Dr. Janet Larsen Palmer, President of Communication Excellence Institute, has over 40 years’ experience as a Professor of Communication, a Fortune 500 corporate manager, a university administrator, trial consultant, and executive coach. As a faculty member at the Executive Leadership and Management Institute at Stanford University and also in the Executive Doctorate Program at the University of Pennsylvania, Dr. Palmer has offered specialized programs on communication skills for business leaders. Janet Larsen Palmer holds a B.S., M.A., and Ph.D. from the School of Communication at Northwestern University, and has won over 25 national and regional awards in communication. Dr. Neal Larsen Palmer is Executive Vice President of Communication Excellence Institute. He has over 40 years’ experience consulting with executives and professionals in business, health care, higher education, law, and government. Formerly the top Dale Carnegie instructor in Southern California, Dr. Palmer taught communication at the
NASA/Jet Propulsion Laboratory in Pasadena and the University of Redlands. He has worked with Dr. Jan Palmer on the faculty of the Executive Leadership and Management Institute at Stanford University and the Executive Doctorate Program at the University of Pennsylvania. A linguist who served as Project Manager in Eastern European research at the Library of Congress, Dr. Neal Palmer worked closely with the intelligence community in Washington, D.C. Neal Palmer reads and speaks twelve languages. He holds a B.S. from Georgetown University, an M.A. from UC Berkeley, and a Ph.D. from The University of Michigan.

Civil Appeal guru Randy Spencer, an accomplished appellate attorney who practices appellate law in both California and Illinois, will dazzle us with his presentation on “The Basics of Civil Appeals.” This presentation will take you through the life of the appellate process, from the filing requirements all the way to the decision of the Court. Valuable insight for you and your clients.

Thanks to a suggestion from TEN Pasadena Moderator Howard Raff, the DTLA TEN Meeting will now be extended an additional 15 minutes to allow for more networking. In addition, we have decided to reward punctual arrival, as opposed to metro travel, and as such, any and all who arrive on the 25th Floor no later than noon will be entered to win a gift card as a reward for their diligence.
